These Terms and Conditions ("Terms") govern your use of the Missly service ("Missly," "the Service") provided by SunLakes AI Labs LLC ("we," "us," or "our"). By using the Service or opting in to receive messages, you agree to these Terms.

Missly SMS Customer Communications

Program Description

Missly provides missed-call text-back and AI voice receptionist services to small businesses. When a consumer calls a Missly-powered business and the call is missed or handled by the AI voice receptionist, Missly sends an SMS response to the consumer's phone number on behalf of that business. Consumers may also opt in explicitly via our web form at sunlakes.ai/missly/sms-opt-in.html.

Message Types

Messages are conversational and transactional only, including:

Missed-call acknowledgments
Appointment confirmations
Appointment reminders
Service follow-ups
Direct responses to questions the consumer asked the business

No marketing or promotional messages are sent through this program.

Message Frequency

Message frequency varies based on your interactions with the business. A typical interaction results in one to three messages.

Message and Data Rates

Message and data rates may apply. Check with your mobile carrier for details on your plan's messaging rates.

Support

Reply HELP to any message for assistance, or contact us at support@sunlakes.ai.

Opt-Out

You can opt out at any time by replying STOP to any message. Upon receiving STOP, we will immediately stop sending you further messages from that business and send you one final confirmation message. To opt back in, text START or contact the business directly.

Supported Carriers

Compatible with all major US carriers including AT&T, Verizon, T-Mobile, and their MVNOs. Carriers are not liable for delayed or undelivered messages.

Privacy

Your phone number and information will only be used to deliver messages from the business you contacted or opted in to. We do not share SMS data with third parties for marketing purposes. See our Privacy Policy for details.

Service Terms

Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service or opt in to receive messages.

Acceptable Use

You agree not to use the Service to send unlawful, harassing, or abusive content; impersonate others; or interfere with the Service's operation.

Business Client Responsibilities

Businesses using Missly to communicate with their customers are responsible for ensuring their communications comply with applicable laws including the Telephone Consumer Protection Act (TCPA) and state-equivalent laws.

Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free operation, or specific results from using the Service.

Limitation of Liability

To the maximum extent permitted by law, SunLakes AI Labs LLC is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the preceding 12 months, if any.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the Effective Date above.

Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of laws principles.
